1. The service
Outbid Naija is a public digital-placement service built around Nigeria’s 36 states and Abuja FCT. A confirmed customer may display an approved name, statement, and permitted link on a territory until another customer completes a valid replacement at the next published price.
A position is not land, title, political authority, intellectual property, an investment, a prize, a wager, or an endorsement by a state, celebrity, fanbase, public body, or any person named in customer content. Words such as claim, take, hold, own, defend, and reclaim describe the display mechanic only.
2. Accounts and eligibility
You must be at least 18, able to enter a binding contract, and provide an email address you control. You are responsible for activity performed through your sign-in code and for keeping access to your mailbox secure.
An email-verified label confirms access to an email account. An X-linked label confirms that an X handle was linked through our stated process. Neither label verifies every claim made by a customer or creates an endorsement.
3. Published price and replacement
The checkout shows a fixed published price for the selected territory. Every replacement pays the full published price shown for that attempt. Bids, deposits, partial payments, pooled prize funds, and payments to the displaced holder are not part of the service.
When a new payment is confirmed and committed, the new customer becomes the current holder and a new next price is published. The displaced holder receives no payout or credit. Previous confirmed events remain in the public record.
4. Confirmation and payment races
A quote or Paystack authorization does not change the map. Only a confirmed ledger event changes the current holder. If two people attempt the same position, the first payment that passes verification and commits against the current territory version wins the position.
A payment that arrives after the territory changed, has the wrong amount or currency, cannot be verified, or cannot be safely committed may be held for review or sent through the published refund process. Do not repeat an uncertain payment unless the result page explicitly offers a new quote.
5. Customer content and licence
You retain any rights you already have in content you submit. You give Outbid Naija a worldwide, non-exclusive, royalty-free licence to host, reproduce, resize, moderate, display, and distribute that content as needed to operate, secure, explain, and promote the public record and its proof cards.
You must have permission to use submitted names, images, statements, and links. Content must not impersonate another person, claim false official status, infringe rights, deceive viewers, threaten or harass, contain hate or unlawful material, or direct people to unsafe services.
6. Moderation and the ledger
We may reject, hide, neutralise, or remove public-facing content and links; restrict an account; or hold a territory while reviewing a report. Moderating a display does not rewrite a confirmed financial event. The public presentation may become neutral while the underlying ledger remains available for audit and operational records.
Report suspected impersonation, infringement, fraud, abuse, or unsafe content through the reporting control or Support. We may ask for evidence and may preserve relevant records while a dispute or legal obligation is active.
7. Refunds, reversals, and chargebacks
A successful placement is a consumed digital service and is not refundable merely because another customer later replaces it. We will return funds where our payment system confirms that money was captured but the placement was not validly delivered, subject to provider processing and identity checks.
Refund submissions that time out or have an uncertain provider response are not automatically repeated. They are reviewed against Paystack records to avoid duplicate refunds. Chargebacks, reversals, fraud claims, and provider instructions may place an account, payment, or territory on administrative hold.
8. Availability and changes
We may pause payments, maintenance, placements, accounts, or the entire experiment to protect customers, reconcile transactions, follow provider instructions, or respond to legal and operational risk. We do not promise uninterrupted availability or that every territory will always accept a new placement.
Material changes to these Terms receive a new version and effective date. A new payment requires acceptance of the then-current version; an old acceptance is not silently carried into a new checkout.
9. Disclaimers and liability
The service is provided on an as-available basis. Public customer content is the speaker’s own content and is not verified or endorsed by Outbid Naija unless we expressly say otherwise. We do not guarantee attention, publicity, resale value, continued placement, or a particular audience reaction.
The final warranty, liability cap, exclusions, indemnity, dispute, governing-law, and jurisdiction language in this draft remains subject to Nigerian counsel review. Nothing in these Terms excludes a right or liability that applicable law does not permit us to exclude.
10. Contact and legal status
Questions about a payment, account, moderation decision, privacy request, or these Terms should be sent through the published Support route with an opaque checkout reference where relevant. Never send a full card number, bank password, OTP, or Paystack credential.
This is a pre-launch draft for product testing and legal review. Live payments remain closed until Nigerian counsel approves the operative Terms and the other published launch gates are evidenced.
